If another person or organisation is at fault for your brain or head injury, then you may be able to claim compensation. If you are enquiring about a loved one who has suffered a brain injury and as a result no longer has capacity, we may be able to assist you to claim on their behalf.

If you are off work as a result of your injury, you may be able to claim compensation for your loss of income, medical costs and also any care and rehabilitation. It is advisable to keep evidence of your losses.
In most cases, personal injury claims must be made within three years from the date of the accident, but this will depend on how the injury was sustained. As an example, if the injury was a result of a criminal assault, then you have two years from the date of the accident to make a claim. If you are claiming on behalf a child, then a claim can be made up until the child turns 21 years of age.
It it always best to seek legal advice as soon as possible in order for us to assist you with obtaining the specialist treatment and services required in order for you to make the best recovery possible.
There are several funding options to assist you with bringing a claim.
You should look to see whether you have an legal expenses insurance (LEI); this can be found on home/motor insurance, some credit cards offer this service or also you may have LEI if you are a member or a trade union. If you have LEI, your legal costs may be covered by your policy.
If you do not have LEI, we can still deal with your injury though a Conditional Fee Agreement (CFA) (also known as a ‘No Win, No Fee’ agreement). We can also assist you with obtaining After the Event (ATE) insurance.
Under a CFA, you only have to pay a fee to us when we are successful in winning you compensation. If you lose your claim – you pay nothing.
With brain and head injuries it can take a long time for the cases to settle. This is based on that it can take several months, if not years, to fully understand the impact the injury will have on your life. If you settle too soon then you will not be able to reopen your case if your symptoms continue or worsen, in which case, you would have been undercompensated for your injuries.
However, as mentioned above, in some cases we can try to obtain an interim payment. This is ‘early compensation’ to assist with your care. Any interim payments made will be deducted from the final figure you receive when your case settles.
If you are successful in your case, the award of compensation can be paid by either one lump sum, periodical payments, or a combination of the two.
With lump sum payments, this means that all the compensation is paid to you in one go which means that you/your family have the task of investing the fund so that it lasts for your lifetime. Lump sums are not always appropriate, especially where there is uncertainty about life expectancy. In addition to this, the lump sum payments will not take into consideration items such as the possible inflation in any future care costs.
Periodical payments are regular payments made by the other side over the course of the injured parties lifetime. Both parties need to agree that payments are made in this way and the relevant applications to the Court will need to be made to make the order. If approved, the payments will be made annually for the rest of your life. The Court will usually order that a lump sum is paid immediately to ensure needs such rehabilitation etc can be made without delay; the periodical payments will be made after this.
Please note that periodical payments are not interim payments.
